These General Terms and Conditions of Sale (GTCS) are entered into between :

hereinafter referred to as «the Seller» or «BAP'», and any person wishing to make a purchase, hereinafter referred to as «the Customer».
2. Object
These GCS govern the sale of takeaway seafood platters offered by Le BAP'. All orders imply unreserved acceptance of these GCS.
3. Products and prices
The seafood platters are prepared to order using fresh produce of the day, sourced directly from the fish market and local producers in the Bigouden region.
Prices are given in euros, inclusive of all taxes (TVA française en vigueur) (5.5 % for takeaway products, 10 % for on-site consumption).
BAP' reserves the right to change its prices at any time. Products are invoiced on the basis of the prices in force at the time the order is validated.
4. Control
Orders can be placed :
- By telephone on 02 98 10 78 81
- By email to Contact@bap.bzh
- On site at the restaurant
All orders are firm and definitive once they have been confirmed by our teams. A summary of the order will be sent to you with the total amount and the agreed collection time.
5. Withdrawal
Platters can be collected directly from the restaurant: 1 route de Penmarc'h, 29120 Plomeur.
Preparation time: minimum 2 hours after order confirmation.
Collection times: 11.30am–9.00pm, 7 days a week (subject to occasional closures).
6. Payment
Payment is made on the spot, when the platter is collected.
Means of payment accepted: cash, bank card, luncheon vouchers (subject to conditions displayed at the cash desk).
7. Right of withdrawal
In accordance with article L.221-28 3° of the French Consumer Code, the right of withdrawal provided by law for online purchases does not apply perishable foodstuffs, including seafood platters and seafood preparations.
8. Cancellation
Cancellations can be made up to 4 hours before the scheduled pick-up time, free of charge. After this time, the tray is considered to be due and must be paid for in full, as the products are already committed to preparation.
9. Storage and consumption
Seafood platters must be kept in a cool place (between 0°C and 4°C) and eaten within 24 hours of collection. The restaurant cannot be held responsible for any delay beyond this period.
10. Allergens and food information
In accordance with EU regulation 1169/2011 (INCO), the list of the 14 major allergens present in our preparations is available:
- On request to our team when ordering
- Displayed in restaurants near the menu
Our platters contain crustaceans, molluscs and fish, and may contain traces of other allergens (gluten, eggs, soya, milk, nuts) as a result of being prepared in a shared kitchen.
11. Legal guarantee
In addition to these GTS, the Customer benefits from the following legal guarantees:
- Legal guarantee of conformity (Articles L.217-3 et seq. of the French Consumer Code)
- Hidden defects guarantee (articles 1641 et seq. of the French Civil Code)
If the product does not conform, the Customer can contact us at Contact@bap.bzh or call 02 98 10 78 81 to assert your rights.
12. Claims
All complaints should be sent to BAP RESTAURANTS by email to Contact@bap.bzh or by telephone on 02 98 10 78 81 as soon as possible after the problem has been identified.
13. Consumer mediation
In accordance with Articles L.612-1 et seq. of the French Consumer Code, in the event of a dispute that cannot be resolved amicably, the Customer may have free recourse to the Consumer Ombudsman :

14. Personal data
The data collected when an order is placed is required for processing and for legal accounting purposes (10 years). It is never passed on to third parties for commercial purposes. For further information, please consult our Privacy policy.
15. Applicable law and jurisdiction
These GCS are governed by French law. In the event of a dispute and after failure of an amicable solution and mediation procedure, the competent court will be that of Quimper.
